Terms of Use for Bus Booking Service on the PesaKit App

These Terms of Use (“Terms”) govern your access to and use of the Bus Booking Service provided through the PesaKit App.

1. About These Terms

1.1 These Terms explain how you may use the bus booking feature on the PesaKit   App.

1.2 By accessing or using the Bus Booking Service, you agree to be bound by these    Terms. If you do not agree with these Terms, you should not use the service.

1.3 These Terms are supplemental to PesaKit’s general Terms of Service and Privacy Policy, which remain applicable.

2. Using the Service

2.1 The service enables users to book bus travel tickets and view related transport information.

2.2 You are solely responsible for any costs and expenses associated with your use of the service, including payment of fare and data charges.

2.3 The service is intended for use in Kenya. Users accessing it from outside Kenya are responsible for complying with applicable local laws.

3. Booking a Ticket

3.1 To book a ticket, you must provide accurate and up-to-date information including:

  • Point of departure
  • Destination
  • Travel date
  • Full name
  • National ID, passport, or alien card number
  • Nationality
  • Mobile phone number

3.2 You warrant that all information submitted is accurate and current.

4. Acceptance of Terms

4.1 You accept these Terms by using the Bus Booking Service or by clicking to agree where prompted during the booking or payment process.

4.2 You also accept these Terms when booking on behalf of another person.

5. Payment of Fare

5.1 Fares are payable at the time of booking and must be paid in full for your ticket to be issued.

5.2 PesaKit and or its partners reserves the right to adjust fares at any time without prior notice.

5.3 You are responsible for any fees or charges resulting from unsuccessful transactions.

5.4 Multiple payment methods may be provided, including mobile money services like M-PESA or your PesaKit app balance.

5.5 You will receive an SMS or a push notification confirmation after successful payment.

5.6 If you do not receive a ticket confirmation after payment, contact support immediately via the app or customer care.

6. Your Ticket

6.1 Upon payment, your ticket will be sent via SMS and or push notification that will include:

  • Your name and phone number
  • Departure and destination locations
  • Reporting time
  • Departure time
  • Seat number (if applicable)

6.2 Some transport providers require physical tickets to be collected at their stations. It is your responsibility to confirm this.

6.3 You must keep your ticket safe and secure, as it must be presented during travel.

7. Refunds and Cancellation

7.1 PesaKit or its parters will not refund lost tickets or missed journeys.

7.2 Alterations, cancellations, or rescheduling should be directed to the transport provider. PesaKit does not facilitate post-purchase changes.

7.3 Refunds will only be issued if a seat you booked is unavailable due to a system error. Refunds will be processed within fourteen working days.

8. Restrictions on Use

You may not use the service if:

  • You are under the legal age to form a binding contract.
  • You are barred under Kenyan law or other applicable jurisdictions.
  • You lack valid travel documents.
  • You are banned by PesaKit or the transport provider.

9. Privacy and Personal Information

Your use of the Bus Booking Service is subject to PesaKit’s Privacy Policy, which outlines how your personal information is collected, used, stored, and shared.

10. Intellectual Property Rights

All intellectual property rights in the PesaKit App and the Bus Booking Service are owned by PesaKit Limited. You may not use any of our content or trademarks without written permission.

11. Limitation of Liability

11.1 PesaKit’s total liability will not exceed the cost of re-supplying the service.

11.2 PesaKit is not liable for indirect, incidental, or consequential damages, including but not limited to loss of profit, data, or business opportunity.

12. Availability and Accuracy

12.1 PesaKit or its partners does not guarantee that the service will be error-free or continuously available.

12.2 The content is for general informational purposes only and should not be considered professional advice.
